1. Seller

2. Scope & acceptance

These Terms & Conditions apply to consumer purchases of Karioska products made through the website.

By confirming an order, the customer acknowledges having read and accepted the Terms & Conditions applicable at the time of purchase.

3. Products & handcrafted character

Karioska sells handcrafted decorative objects and works of African craftsmanship.

Product descriptions and photographs are prepared with care. Because pieces are handmade from natural materials, reasonable variations in colour, form, texture, beadwork, feathers or finish are part of their artisanal character and may occur from one piece to another.

Such natural and artisanal variations do not in themselves constitute a lack of conformity where the piece otherwise corresponds to the description and essential characteristics presented at the time of purchase.

4. Availability

Products are offered subject to availability.

If a product becomes unavailable after an order has been placed, Karioska will inform the customer and propose the legally appropriate solution, which may include replacement, waiting for artisan production or reimbursement.

5. Prices

Prices displayed on the website may be presented in different currencies according to the customer’s selected market.

The total amount payable, including applicable taxes and shipping charges, is displayed before final confirmation of the order.

Karioska may modify prices prospectively. The price applicable to an order is the price confirmed when that order is validated.

6. Orders

The customer selects the desired products, provides the information required for delivery and billing, and confirms payment.

The sale becomes final after confirmation of the order and successful collection or authorization of the required payment, subject to applicable consumer rights.

Karioska may contact the customer where information is incomplete, inconsistent or requires verification.

7. Payment

Orders placed on Karioska involve an obligation to pay.

Payments are made using the secure payment methods displayed at checkout. Available payment options may vary according to market, location and payment-provider eligibility.

Karioska may suspend or refuse an order where payment is refused, incomplete, fraudulent or subject to a payment dispute.

8. Delivery

Available delivery destinations and shipping charges are displayed at checkout.

As an indication, delivery to Europe and the United States generally takes approximately 5 to 7 business days once the order is ready for dispatch. Additional artisan preparation may apply to certain pieces.

The customer is responsible for providing a complete and accurate delivery address.

9. Delivery incidents

The customer should inspect the parcel and piece promptly after delivery and notify Karioska as soon as possible of any damage, error or apparent non-conformity.

Where goods are damaged or non-conforming, the customer’s statutory rights apply and the cost of remedying a seller-attributable problem is not transferred to the customer.

10. Right of withdrawal

Except where a statutory exception applies, a consumer has 14 days from receipt of the goods to notify Karioska of the decision to withdraw.

The goods must then be returned no later than 14 days after communicating that decision.

The direct return cost is borne by the customer for a standard withdrawal, provided the customer was informed of that cost before purchase.

11. Exceptions to withdrawal

The right of withdrawal may be excluded in the cases provided by law, including goods made to the customer’s specifications or clearly personalized.

Any relevant exception will be identified before the customer confirms the affected order.

12. Refunds

Where a valid withdrawal applies, Karioska refunds the amounts due within the statutory timeframe using the original payment method unless otherwise expressly agreed.

Karioska may defer reimbursement until the goods are received or until the customer provides evidence of dispatch, whichever occurs first.

13. Legal guarantee of conformity

Consumers benefit from the legal guarantee of conformity under French consumer law.

For goods, the consumer may act under this guarantee for two years from delivery under the conditions provided by law.

These statutory guarantees apply independently of any commercial gesture or additional warranty.

14. Hidden defects

The customer also benefits from the legal guarantee against hidden defects under Articles 1641 and following of the French Civil Code, subject to the legal conditions governing that guarantee.

15. Intellectual property

The Karioska name, brand assets, texts, photographs, designs and website content are protected by applicable intellectual-property rights.

Their reproduction or commercial reuse without authorization is prohibited except where permitted by law.

16. Personal data

Personal data may be processed where necessary to operate customer accounts, process orders, deliver products, prevent fraud, provide customer service and comply with legal obligations.

Marketing communications are subject to the applicable consent and preference rules.

17. Force majeure

A party will not be liable for failure or delay caused by an event outside its reasonable control where the legal conditions of force majeure are met.

The parties will seek an appropriate solution if such an event materially prevents performance of the order.

18. Complaints & amicable resolution

For any complaint, the customer should first contact Karioska at hello@karioska.com so that an amicable solution can be sought.

Consumer mediation information will be added once S2KA has formally designated and joined an approved consumer mediator.

19. Applicable law & language

These Terms & Conditions are governed by French law, without depriving consumers of any mandatory protections that may apply to them under applicable law.

The French version is the reference version. Translations are provided for convenience.

Withdrawal form

To exercise the right of withdrawal, the consumer may send an unambiguous statement or use the following model:
